Ethical Dilemma: The AI Summary
The Situation
A busy courthouse begins experimenting with AI-generated summaries of interpreted proceedings for internal administrative use. Court staff clarify that the summaries are:

At first, the summaries seem harmless.
Over time, however, attorneys and court staff begin casually referencing them during scheduling discussions and case preparation.
One afternoon, after a hearing you interpreted, an attorney approaches you and says:
“The AI summary says the defendant admitted knowing about the weapon.”
You immediately recognize the problem.
The defendant never stated they knew about the weapon. The actual testimony was far more uncertain. The defendant stated they suspected the weapon might be present.
The nuance was lost in the AI-generated summary.
You explain the distinction.
The attorney shrugs and replies:
“Well, it’s close enough.”
The AI summary is not part of the official record.
Yet people are beginning to rely on it anyway.
Weeks later, you notice attorneys quoting AI-generated summaries more frequently in conversations surrounding interpreted hearings.
Some court staff argue the tool saves time and improves workflow efficiency.
Others quietly express concern that the summaries flatten nuance, certainty, and tone in ways that could shape how limited English proficient individuals are perceived.
The summaries continue circulating internally.
Unofficially.
But consistently.
Question:

I would be very careful about framing this as an interpreter ethics dilemma.
The interpreter’s professional responsibility is to render the proceeding accurately and completely in the mode required by the court. If the interpreter did that, and a third-party AI tool later generated an inaccurate summary, the problem is not the interpreter’s rendition. It is the court’s use, circulation, and informal reliance on an unreliable secondary product.
Several questions matter here:
Did the AI listen to the original-language testimony and summarize that directly, or did it summarize the English rendition that became part of the interpreted proceeding? If it worked from the interpreter’s rendition, then the issue is not “interpreted proceedings” as such. It is the same problem that would arise with any AI-generated summary of English-language testimony: summarization can distort certainty, intent, nuance, and legal significance.
If an English-speaking witness said, “I suspected the weapon might be there,” and an AI summary turned that into “the defendant admitted knowing about the weapon,” would we expect the court reporter, clerk, or any individual courtroom participant to intervene as an advocate? Probably not. The concern would be institutional: the court should not allow unofficial AI summaries to influence case preparation, scheduling discussions, charging decisions, plea negotiations, or judicial perception.
That is why I think this example feels forced if it places the ethical burden on the interpreter. Interpreters should not become monitors, correctors, or advocates regarding unofficial AI summaries floating around the courthouse. That is outside the role and potentially compromises neutrality.
That said, there is a valid systemic concern here. If court personnel are relying on AI summaries that distort testimony, especially testimony involving LEP parties or witnesses, then administrators, judges, attorneys, and interpreter services managers should address it through policy. The solution is not for individual interpreters to police the summaries. The solution is a clear rule that AI summaries are not the record, may not be quoted as if they were the record, may not substitute for transcripts or audio, and must be checked against the official record before being used in any legally meaningful way.
I have serious concerns about AI summaries, AI translation, and the use of AI to replace qualified interpreters. Those are real ethical and due process issues. But this particular scenario seems to conflate those concerns with a responsibility that does not properly belong to the interpreter. The ethical risk is real. The proposed locus of responsibility is the problem.
I agree with Katty. It is not a matter interpreter ethics; rather, as Katty puts it, “Those are real ethical and due process issues.”
When I read the described scenario, the term “role boundaries” immediately came to mind. I agree wholeheartedly with Katty’s assessment, i.e., that this is a systemic issue that requires a systemic level response rather than from an individual interpreter. However, I do appreciate the NAJIT Observer Team raising the issue as it is not one that I have personally encountered. Clearly the use of AI has already entered the judicial realm and we do well to not only be aware of it, but also know how it impacts our work and what can and should be our response both individually and collectively as a profession to its expanded use in legal settings.
